Following the decision dated June 27th, 2005 by Judge Baker of the Quebec superior Court, who rejected the company’s request regarding arbitrator Foisy about the beard and length of hair, the Quebec Court of Appeals chaired by Judge Pierre Dalphond ordered last July 27th, that the request be reverted to the Superior Court so that the dispute be decided on the merits of the affair, that is:

Did arbitrator Foisy exceed his jurisdiction when he cancelled the company’s policy regarding beards and length of hair?

Thus, the decision of Judge Bishop dated December 14th, 2003 which ordered the stay of arbitrator Foisy’s decision is still in force (the company’s policy is still valid until a final decision is rendered by the Superior Court).
