Des progr\u00e8s en mati\u00e8re de droit du travail et de r\u00e9solutions des litiges ont \u00e9t\u00e9 enregistr\u00e9s, mais des doutes subsistent en ce qui a trait \u00e0 l\u2019industrie laiti\u00e8re, a expliqu\u00e9 le pr\u00e9sident de Teamsters Canada, Fran\u00e7ois Laporte. En bout de piste, le diable se trouve dans les d\u00e9tails et c\u2019est la raison pour laquelle les Teamsters des deux c\u00f4t\u00e9s de la fronti\u00e8re vont d\u2019abord analyser l\u2019entente en d\u00e9tail avant de l\u2019appuyer. \u00bb<\/p>\n<p><strong>Laiteries<\/strong><\/p>\n<p>Les concessions effectu\u00e9es en ce qui a trait \u00e0 l\u2019acc\u00e8s au march\u00e9 canadien des produits laitiers sont pr\u00e9occupantes. Rappelons que les produits laitiers ne faisaient pas partie de la premi\u00e8re version de l\u2019AL\u00c9NA et n\u2019auraient pas d\u00fb \u00eatre int\u00e9gr\u00e9s dans la nouvelle entente. On peine \u00e0 croire que ces compromis vont b\u00e9n\u00e9ficier au monde rural et aux centaines de milliers de Canadiens et de Canadiennes qui oeuvrent dans cette industrie.<\/p>\n<p>Il ne faut pas oublier que ces concessions proviennent d\u2019ententes commerciales n\u00e9goci\u00e9es au cours des derni\u00e8res ann\u00e9es. Celles-ci donnent acc\u00e8s au march\u00e9 des produits laitiers canadien \u00e0 d\u2019autres pays. Ainsi, on a sacrifi\u00e9 l\u2019\u00e9quivalent de 250 M$ annuellement au profit d\u2019industries \u00e9trang\u00e8res.<\/p>\n<p><strong>Travail<\/strong><\/p>\n<p>Nous sommes heureux de constater que des progr\u00e8s ont \u00e9t\u00e9 faits en mati\u00e8re de droit du travail. En th\u00e9orie, les droits des travailleurs ont \u00e9t\u00e9 am\u00e9lior\u00e9s par rapport \u00e0 l\u2019ancienne version de l\u2019AL\u00c9NA et au Partenariat transpacifique, notamment pour ce qui est du travail des enfants. Cependant, la mise en application de cette partie de l\u2019entente reste \u00e0 prouver et les innombrables notes de fin de page devront \u00eatre \u00e9tudi\u00e9es de plus pr\u00e8s.<\/p>\n<p><strong>Transport<\/strong><\/p>\n<p>D\u00e9sormais, les \u00c9tats-Unis se r\u00e9servent le droit de mettre en place de nouvelles restrictions aux transporteurs mexicains. Le syndicat des Teamsters travaillera de concert avec l\u2019administration et le Congr\u00e8s am\u00e9ricain afin de cr\u00e9er des lois et des r\u00e8glements dans l\u2019optique de prot\u00e9ger les emplois dans cette industrie, d\u2019am\u00e9liorer le bilan en s\u00e9curit\u00e9 routi\u00e8re et de r\u00e9pondre \u00e0 certains enjeux environnementaux.<\/p>\n<p>Malheureusement, les gouvernements am\u00e9ricain et canadien n\u2019ont pas abord\u00e9 un enjeu similaire \u00e0 celui du transport routier dans l\u2019industrie ferroviaire. Pourtant, les Teamsters ont fait des pressions aupr\u00e8s des deux gouvernements afin d\u2019emp\u00eacher que des cheminots d\u2019un pays puissent conduire des trains dans un autre pays plut\u00f4t que d\u2019effectuer un changement d\u2019\u00e9quipe \u00e0 la fronti\u00e8re.<\/p>\n<p><strong>M\u00e9canisme de r\u00e8glement des diff\u00e9rends entre investisseurs et \u00c9tats<\/strong><\/p>\n<p>Le m\u00e9canisme de r\u00e8glement des diff\u00e9rends entre investisseurs et \u00c9tats permet \u00e0 une entreprise \u00e9trang\u00e8re de poursuivre le Canada, par exemple, devant un tribunal arbitral international avant m\u00eame de d\u00e9poser une poursuite devant les tribunaux canadiens. Ce m\u00e9canisme a suppos\u00e9ment \u00e9t\u00e9 con\u00e7u pour prot\u00e9ger les investisseurs \u00e9trangers de discrimination.<\/p>\n<p>Nous sommes heureux que cette mesure controvers\u00e9e ait \u00e9t\u00e9 retir\u00e9e de l\u2019entente finale. Sous ce m\u00e9canisme, le Canada \u00e9tait devenu la nation la plus poursuivie dans l\u2019AL\u00c9NA \u00e0 cause, notamment, de ses lois environnementales et de sant\u00e9 et s\u00e9curit\u00e9 plus s\u00e9v\u00e8res. Les int\u00e9r\u00eats corporatifs ne devraient jamais \u00eatre plus importants que ceux du public.<\/p>\n<p><strong>Barri\u00e8res tarifaires<\/strong><\/p>\n<p>Nous sommes d\u00e9\u00e7us de constater que les n\u00e9gociateurs n\u2019ont pas trouv\u00e9 de solution en ce qui a trait aux barri\u00e8res tarifaires impos\u00e9es par les \u00c9tats-Unis sur l\u2019acier et l\u2019aluminium canadiens. Ces barri\u00e8res commerciales ont des impacts n\u00e9gatifs sur les Teamsters oeuvrant dans le secteur manufacturier. De fait, il est ridicule de croire que le Canada repr\u00e9sente une menace pour la s\u00e9curit\u00e9 nationale de d\u2019autres pays, particuli\u00e8rement celle des \u00c9tats-Unis.<\/p>\n<p><em>Le syndicat des Teamsters repr\u00e9sente les int\u00e9r\u00eats de pr\u00e8s de 125 000 travailleuses et travailleurs au Canada. Teamsters Canada est affili\u00e9 \u00e0 la Fraternit\u00e9 internationale des Teamsters, dont l\u2019effectif syndical est de 1,4 million de membres en Am\u00e9rique du Nord.<\/em><\/p>\n<p
